Section 3 – User Eligibility and Account Responsibilities

Section 5 – Product Authenticity and Imitation Warnings
FHGS Vestimentaire collaborates with a network of global manufacturers, suppliers, dropshipping partners, and wholesalers to provide our products. As a result, certain products or images may appear on other platforms due to shared supply chains and partnerships. However, only purchases made directly through our official website or authorized partners are guaranteed to be authentic and eligible for customer support, returns, and related services. We are not responsible for counterfeit products, scams, or misrepresentations made by third-party sellers. If you encounter a seller claiming to represent FHGS Vestimentaire, we strongly recommend contacting us directly through our official contact channels to verify legitimacy before making a purchase. Unauthorized use of FHGS Vestimentaire branding, product images, or copyrighted material is strictly prohibited and will result in legal action to the fullest extent permitted by law.
Section 6 – Shipping and Delivery Policy
Orders are typically processed within one (1) week of verification, though processing times may vary depending on product availability and demand. Delivery times generally range from two (2) to four (4) weeks for international shipments. Delays may occur due to customs inspections, holidays, or carrier-related issues. Once your order has shipped, you will receive a tracking number via email to monitor its progress. We offer free international shipping through carriers such as UPS, FedEx, and DHL. Most orders are shipped under Delivered Duty Paid (DDP) terms, meaning taxes and duties are prepaid by FHGS Vestimentaire. However, customers in certain regions may receive shipments under Delivered Duty Unpaid (DDU) terms, which require payment of additional fees upon delivery. If you provide an incorrect or invalid shipping address, your order may be canceled. You must contact us immediately to correct any errors. Once an order has been shipped, FHGS Vestimentaire is not liable for packages that are lost, stolen, or damaged during transit. Section 7 – Returns, Refunds, and Exchanges
We accept returns within fourteen (14) days of delivery for items that are unworn, undamaged, and in their original packaging with all tags attached. Returns are eligible for store credit only, no cash refunds will be issued. Items marked as final sale cannot be returned or exchanged. For international returns where the customer refuses to pay duties or taxes, a 25% restocking fee will be deducted from the refund amount. If you receive a damaged or defective item, do not open the package. Instead, contact us immediately with photographic or video evidence of the damage. We will initiate an investigation and provide further instructions. Please note that manufacturing defects are only covered for items purchased directly from FHGS Vestimentaire. Section 8 – Order Acceptance, Pricing, and Resale Policy
All prices listed on our website are in Canadian Dollars (CAD). FHGS Vestimentaire reserves the right to refuse, limit, or cancel any order placed with us at our sole discretion. This may include limiting quantities purchased per person, per household, or per order. These restrictions may apply to orders placed under the same customer account, payment method, and/or billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. We also reserve the right to restrict or discontinue business with any customer found to be in violation of this policy. This policy may be updated at any time without prior notice and applies to all purchases made through our online store. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You also agree to promptly update your account details and other information, including your email address and credit card numbers and expiration dates, to ensure successful transaction processing and communication. FHGS Vestimentaire reserves the right to cancel any order in the event of pricing errors, system glitches, or unauthorized use of discount codes. This includes, but is not limited to, situations involving non-public promotional codes or significant pricing inaccuracies. In such cases, we are under no obligation to fulfill the order, and any payments received will be refunded in full.

Occasionally, information on our site or within the Service may contain typographical errors, inaccuracies, or omissions. These may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, or product availability. We are not obligated to update, amend, or clarify information on the Service or on any related website, including pricing information, except as required by law. FHGS Vestimentaire is not responsible for delays, losses, or delivery issues caused by shipping carriers, customs authorities, weather conditions, international transit disruptions, or other third-party service providers beyond our control. Additionally, FHGS Vestimentaire disclaims all liability arising from misuse of products, failure to follow provided care instructions, improper handling, unauthorized modifications, or use inconsistent with the intended purpose of the product. In all cases, FHGS Vestimentaire’s total liability shall not exceed the amount paid by the customer for the applicable order or product.
Section 15 – Force Majeure
FHGS Vestimentaire shall not be liable for any delay, interruption, or failure to perform resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, labor disputes or strikes, supply chain disruptions, transportation delays, internet or system failures, governmental actions, or changes in laws and regulations. Any obligations affected by such events shall be suspended for the duration of the force majeure event. FHGS Vestimentaire will make reasonable efforts to resume operations and fulfill affected obligations as soon as reasonably possible once the situation has been resolved.

By subscribing to FHGS Vestimentaire SMS alerts, you consent to receive recurring automated marketing and promotional text messages from FHGS Vestimentaire. Message and data rates may apply depending on your mobile carrier. Consent is not a condition of purchase. You may opt out at any time by replying “STOP” to any message.
Section 18 – Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Canada and the Province of Quebec, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of our website shall be resolved through binding arbitration in Montreal, Quebec, except where prohibited by applicable law. By using our services, you waive any right to participate in a class action lawsuit or class-wide arbitration proceeding.
